About 10.44pm on Monday, May 7, police were travelling south along Acacia Drive when they sighted a white Holden Rodeo utility exit Beech Street and onto Acacia Drive.
At the time of entering the street, the vehicle nearly collided with the easterly gutter of Acacia Drive as it appeared the driver had taken the turn too late.
The vehicle continued travelling south and police took up position behind the ute, before activating their warning devices to signal it to pull over.
Officers saw the accused in the driver’s seat of the vehicle and was the sole occupant.
The man, 43, was submitted to a breath test that returned a positive result.
He was arrested and taken to Muswellbrook Police Station where he was submitted to a breath analysis that returned a result of 0.097 grams of alcohol in 210 litres of breath.
Due to the mid-range reading, the accused’s licence was immediately suspended.
He is scheduled to appear at Muswellbrook Local Court on June 4.
